TERMS AND CONDITIONS VILLA DEL VALLE – CALLOSA D’EN SARRIÀ
Villa del Valle, located in 03510, Callosa d’en Sarrià, (hereinafter “Villa del Valle”) applies the following General Terms and Conditions. These Terms and Conditions are in force from the moment the reservation is confirmed by mail until the end of the reservation date.
1. General
1.1. The Terms and Conditions apply to all guests of Villa del Valle.
1.2. A guest in these General Conditions means all persons who:
a. have a confirmed booking by mail or
b. are staying at Villa del Valle on the basis of written approval from the owners or
c. are using the facilities offered by Villa del Valle.
1.3. Jesse Wurtz and Jessica Marcus are the owners and representatives of Villa del Valle. They have the right to appoint third parties as managers.
1.4. Villa del Valle in these Terms and Conditions means its owners, representatives or managers.
1.5. Villa del Valle reserves the right to modify the Terms and Conditions.
1.6. Information about Villa del Valle is available through various online and offline sources. Although Villa del Valle tries to keep these sources as up-to-date as possible, the guest cannot derive any rights from this information.
2. Damages and disputes
2.1. The administration of Villa del Valle is decisive in case of disagreements between them unless the guest can prove otherwise.
2.2. In case of disputes all (legal) costs shall be borne by the guest.
2.3. Damage and loss of movable and immovable property of Villa del Valle caused by the guest must be reported immediately by the guest.
2.4. The cost of the damage and/or loss caused by the guest will be deducted from the deposit (see also 7. Deposit). These costs will be specified and substantiated by the owners to the guest by mail.
2.5. If the cost of the damage and/or loss caused by the guest exceeds the deposit, these additional costs will be charged to the guest. These must be paid within 14 days of notification to the guest.
3. Identification
All guests over 15 years of age must be able to identify themselves upon arrival by means of a valid identification document. This can be a valid passport or an identity card from a country within the European Union. Villa del Valle is obliged to make a copy of this identification document and to register all guests over 15 years old with the Guardia Civil upon arrival.
If not all guests over 15 years old before booking can identify themselves and/or fail to provide a copy after arrival, Villa del Valle reserves the right to cancel the booking without the possibility of a refund of the costs incurred.
4. Conduct
4.1. The guest must at all times follow the instructions of the owners and/or managers.
4.2. The guest must behave as a good guest and not cause nuisance to surrounding residents.
4.3. Villa del Valle may, in the event of breach of these Terms and Conditions and/or inappropriate behaviour, deny or refuse entry to the premises belonging to Villa del Valle with immediate effect, without giving reasons and without refund of accommodation expenses.
5. Risks and liability
5.1. Villa del Valle is not liable for damage to, loss or theft of the properties of the guest.
5.2. Villa del Valle is not responsible for accidents or injuries of the guest incurred during or caused by the stay at Villa del Valle.
5.3. All risks relating to the stay at Villa del Valle shall be borne by the guest.
5.4. Parents are at all times responsible for the safety, health and welfare of their children.
5.5. Parents must continuously supervise their children, on the property, as well as in and around the pool area.
5.6. Villa del Valle is not liable for any inconvenience or damage caused by disturbances such as power outages, wifi, the water supply or technical installations.
5.7. Villa del Valle is not liable for nuisance during the guest’s stay due to heat, drought, pest infestation and other causes leading to nuisance.
6. Reservation and confirmation
6.1. The reservation can be made by e-mail or through the Villa del Valle website.
6.2. After receiving a reservation request, Villa del Valle will send (either through a third party) a confirmation of the booking if Villa del Valle is available. Only after confirmation by mail or in writing is the reservation final.
7. Deposit
7.1. For each stay by a guest at Villa del Valle a deposit of €1000 will be charged.
7.2. If there is no damage and/or missing movable and immovable property of Villa del Valle, the owners are obliged to return the deposit within 7 days.
8. Rates and payment
8.1. After the confirmation of the booking by mail, a deposit of 40% of the booking amount is requested.
8.2. Payment of the full reservation amount and the deposit for the stay at Villa del Valle must be made in advance, with a maximum of 14 days before the reservation date.
8.3. If the full reservation amount and/or deposit is not paid and/or payment is not made until 14 days before the reservation date Villa del Valle has the right to cancel the reservation without confirmation.
8.3. Advertised rates include the use of water, electricity up to 150 kWh and Wifi.
8.4. If energy consumption exceeds by 150 kWh per week during the guest’s stay, there will be an additional charge of € 0,39 per kWh. These additional charges will be deducted from the deposit.
8.5. Advertised rates are inclusive of VAT.
8.6. Villa del Valle reserves the right to change the rates.
8.7. Advertised rates are subject to change.
9. Cancellation, early departure and no show (failure to arrive without cancellation)
9.1. If the guest is unable to comply with the confirmed reservation, the guest must notify this as soon as possible so that the resulting vacant date can still be offered to third parties.
9.2. Early departure shall not entitle the guest to a refund of all or part of the cost of the stay.
9.3. In the event of cancellation and no show, the following shall apply:
a. If cancelled at least 14 calendar days before the booking start date, no costs will be charged.
b. In case of cancellation less than 14 calendar days before the booking start date or the guest does not show up, the full amount for the stay is due.
10. Other
10.1. The guest will receive on arrival a set of keys for the villa and for the entrance to Villa del Valle. This must be returned at check-out. Loss and/or theft of the key is at guest’s expense (€ 25) and will be deducted from the deposit after guest’s check-out.
10.2. Pets are not allowed in Villa del Valle. If this is not complied with by the guest, Villa del Valle may claim compensation from the guest equal to € 150 per day per animal for each day the animal is on the premises of Villa del Valle. Additional costs arising from the presence of the animal such as cleaning costs, costs for damage caused or costs resulting from loss of income due to nuisance to other guests, will be recovered from the guest.
